Civil / Personal Injury Results

Prior to founding the firm, civil litigation partner Luis Umana obtained a $6.2 million verdict in a nursing home negligence matter.

Since commencing the firm, the firm has secured substantial recoveries for clients in wrongful death, catastrophic injury, negligence, and highly sensitive personal injury matters, including:

• $4 million pre-suit settlement obtained on behalf of clients in a wrongful death matter.

• $1.1 million arbitration resolution obtained in a complex shareholder dispute in which the firm’s client was the defendant.

• Confidential pre-suit settlement against a major moving company arising from a wrongful death matter involving complex Graves Amendment liability issues.

• $350,000 settlement for a client who sustained a back injury despite requiring no surgery.

• Six-figure recovery for a client who was the victim of a sexual assault after the matter had previously been rejected by four separate law firms.

• $100,000 recovery obtained in connection with IVF negligence claims.

The firm focuses on maximizing value in complex and emotionally sensitive matters through aggressive pre-suit investigation, strategic litigation positioning, and high-level negotiation. The firm is particularly selective in pursuing cases involving significant liability disputes, difficult damages issues, or matters other firms decline to pursue.

Criminal Results

Prior to founding the firm, Elizabeth Johannesen worked on a significant federal matter involving allegations under the Foreign Corrupt Practices Act (FCPA), Sarbanes-Oxley, and related bribery offenses, which ultimately resulted in dismissal.

Since commencing the firm, the criminal defense and investigations practice has obtained significant results in high-stakes matters involving constitutional litigation, pre-indictment advocacy, and complex felony investigations, including:

• Full dismissal of a statutory rape prosecution in Westchester County after uncovering Brady and Giglio violations stemming from the prosecution’s failure to disclose exculpatory witness information, including a witness who stated that the alleged incident did not occur.

• Successful pre-indictment resolution of an internet sex offense investigation involving search warrants and client admissions, resulting in a misdemeanor disposition with no jail sentence. The firm successfully held prosecutors off from indictment while litigating significant constitutional and jurisdictional issues relating to the underlying search and seizure process, including issues involving federal customs authorities rather than local law enforcement.

• Negotiation of a misdemeanor disposition in Nassau County for a client facing allegations involving approximately seventeen illegal firearms.

• Full dismissal of a DWI prosecution in the Bronx.

• Ongoing successful pre-indictment advocacy in a felony strangulation investigation in which the firm successfully moved prosecutors away from seeking indictment while continuing to litigate and negotiate the matter.

The firm approaches criminal defense matters with an aggressive, investigative, and highly strategic mindset, particularly in cases involving constitutional violations, digital evidence, parallel investigations, reputational risk, and pre-indictment intervention.
